State
The CPSIA does include a provision regarding preemption, which essentially states that if a requirement is covered by a Federal regulation – whether the Consumer Product Safety Act (CPSA), the Federal Hazardous Substances Act, the Flammable Fabrics Act, the Poison Prevention Packaging Act, or another Federal regulation – then the State or local law is preempted. However, the preemption clause does not cover any State or local warning requirements.
In addition to California Proposition 65 there are other State requirements that are not covered by any Federal regulation. This page focuses focus on the State regulations that are most significant to the promotional products industry. Please be aware that this is not all-inclusive and does not cover all State regulations. It’s intended to focus on the State regulations that are most significant to the promotional products industry.

The CPSC's position on voluntary standards is that if you do not comply with voluntary standards, they are going to consider it a substantial product hazard and recall the product - Holiday Lights Letter.

Rules Requiring a General Certificate of Conformity (GCC) - General Use/Non-Children's Products
This page is a direct excerpt from the Consumer Product Safety Commission website for the purpose of providing guidance with regard to General Certificates of Conformity (GCC). This information can also be found on the Consumer Product Safety Commission (CPSC) website.
Manufacturers and importers of general use products (i.e., non-children’s products) for which consumer product safety rules apply, must certify in a General Certificate of Conformity (GCC) that their product(s) comply with all applicable rules. A manufacturer or importer of such a product must support its GCC with records from a test of each product or a reasonable testing program.
Below is a list of rules that require the issuance of a GCC. See the CPSC webpages on reasonable testing programs and GCCs for more information.
Note 1: The use of CPSC-accepted testing laboratories to conduct required testing is not a requirement for general use, or non-children’s, products. First party testing, or testing from any qualified laboratory or test facility, can support a GCC.
Note 2: Certain regulations contain product-specific requirements outlining a reasonable testing program and the responsible party in the supply chain specifically responsible for issuing the GCC. Consult the list of those regulations here: Rules Requiring Third-Party Testing.

*For certification of banned products, please consult the following Commission document for specific guidance about the class of products for which the Commission expects issuance of a GCC. The Commission has provided guidance regarding which bans require certification, recognizing that it may be difficult to distinguish between rules that ban an entire product category, leaving no products left to certify, and rules that ban a subset of the product category, and therefore, require certification. Some bans enforced by the Commission apply to multiple products or more than one product category.
This overview was updated on Nov. 28, 2014 ay the CPSC and is a tool that may be used in conjunction with consumer product safety rules. This overview is not intended to replace or supersede any sections of federal law. In the case of any discrepancies between this overview and federal law, federal law will supersede this overview.

Manufacturer and Exporter Information (China)
Since 2004, Consumer Product Safety Commission (CPSC) has worked directly with Chinese stakeholders to improve the safety of consumer products exported to the United States. These efforts include regular contact with Chinese government authorities through their Beijing office, as well as education and outreach programs to the entire supply chain in China. The CPSC provides training and guidance to Chinese manufacturers and exporters through in-person training, live webinars, and Web-based Chinese language materials that provide information on U.S. requirements for consumer products.
